1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "user") and ProjectMods ("ProjectMods", "we", "us", "our"), governing your access to and use of the ProjectMods website, applications, services, community features, mods, and related media (collectively, the "Services").
ProjectMods is operated by a general partnership based in Victoria, Australia. You can contact us at [email protected] for any questions or notices under these Terms.
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree, you must discontinue use immediately.
Supplemental terms, policies, or documents that may be posted on the Services from time to time are incorporated by reference.
2. Eligibility & User Representations
By using the Services, you represent and warrant that:
- You are at least 13 years of age (the Services are not intended for, and may not be used by, anyone under 13)
- If you are below the age of digital consent in your country (for example, 16 in some parts of the European Economic Area), your parent or legal guardian has reviewed these Terms and consents to your use of the Services
- If you are under 18 (or the age of majority where you live), you only make purchases or start a paid subscription with the involvement of a parent or guardian who agrees to these Terms
- You have legal capacity to enter into these Terms
- Information you provide is accurate, current, and complete, and you will keep it updated
- You will not use the Services for unlawful or unauthorised purposes
- You will not access the Services through automated or non-human means (bots, scripts, scraping tools), except through standard browser/search engine usage
We reserve the right to suspend or terminate accounts for false, inaccurate, or incomplete information.
3. Accounts & Registration
- You may be required to register an account to access parts of the Services
- You are responsible for maintaining the confidentiality of your credentials
- You are responsible for all activity under your account
- We may remove, reclaim, or change usernames that are inappropriate, misleading, obscene, or otherwise objectionable at our discretion
4. Intellectual Property Rights
Unless otherwise stated:
- The Services and all associated source code, databases, functionality, software, website and app designs, audio, video, text, photographs, graphics, and other content provided by ProjectMods (collectively, the "Content") and trademarks, service marks, and logos (the "Marks") are owned or controlled by ProjectMods or licensed to ProjectMods
- The Content and Marks are protected by applicable intellectual property laws
- You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use only
Except as expressly permitted by these Terms, you may not copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or otherwise exploit any Content or Marks for commercial purposes without our prior written permission.
All rights not expressly granted are reserved.
5. User Content, Contributions & Suggestions
5.1 User-Generated Content
The Services may allow you to submit, post, upload, publish, display, transmit, or otherwise make available content, including text, writings, video, audio, photographs, graphics, comments, mod ideas, suggestions, feedback, mods, or other materials (collectively, "User Content").
You retain ownership of your User Content as submitted, subject to the license granted below.
5.2 User Content Standards (Representations)
By submitting User Content, you represent and warrant that:
- Your User Content does not infringe any third-party rights (copyright, trademark, patent, trade secret, moral rights, privacy/publicity rights)
- You have the required rights, licenses, consents, and permissions to submit the User Content
- Your User Content is not false, misleading, unlawful, defamatory, obscene, harassing, abusive, or otherwise objectionable
- Your User Content does not include unsolicited advertising, spam, or solicitation
- Your User Content does not solicit personal information from minors or violate laws protecting minors
- Your User Content complies with applicable laws and these Terms
5.3 License You Grant to ProjectMods
By submitting User Content, you grant ProjectMods a worldwide, non-exclusive, royalty-free, fully-paid, perpetual, transferable, sublicensable license to:
- Host, store, use, reproduce, modify, adapt, publish, translate, transmit, display, perform, and distribute User Content
- Use ideas, concepts, suggestions, or feedback for operating, improving, and promoting the Services and for building mods or features
This license applies in any media or technology now known or later developed.
To the extent permitted by law, you waive any moral rights in your User Content.
We do not claim ownership of your User Content as submitted, but we do require the above license to run and improve the Services.
5.4 Suggestions & Ownership of Built Mods
Any questions, comments, suggestions, ideas, feedback, or other submissions regarding the Services ("Submissions") are provided on a non-confidential basis.
- Submission does not guarantee implementation
- ProjectMods may accept, modify, prioritise, or reject suggestions at our sole discretion
- Any mods, features, tools, content, or implementations built by ProjectMods, including those inspired by user submissions, are the exclusive property of ProjectMods
- No compensation or royalties are owed unless explicitly agreed in writing
We may provide recognition (e.g., attribution, leaderboards, virtual rewards) at our discretion.
5.5 Moderation Rights
ProjectMods may, in our sole discretion and without notice:
- Edit, redact, re-categorise, restrict, or remove User Content
- Pre-screen content
- Disable access to content that is excessive in size or burdensome to our systems
We have no obligation to monitor User Content.
6. Prohibited Activities
You may not use the Services for any purpose other than that for which they are made available.
You agree not to:
- Systematically retrieve data or content to create compilations, databases, or directories without written permission
- Trick, defraud, or mislead ProjectMods or other users
- Circumvent, disable, or interfere with security features
- Disparage, tarnish, or harm ProjectMods or the Services
- Harass, abuse, or harm another person
- Submit false reports to support channels
- Use the Services inconsistently with applicable laws
- Advertise or offer to sell goods/services through the Services without permission
- Upload or transmit viruses, Trojan horses, spyware, or harmful code
- Engage in automated use (bots, scripts, scraping, data mining)
- Delete copyright or proprietary notices
- Impersonate others or use another user's account or username
- Sell or transfer your profile
- Reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to derive the source code of any part of the Services
- Modify, adapt, translate, or create derivative works of the Services, including the ProjectMods website, desktop application, installers, or any associated software, except as expressly permitted by law
- Hack, exploit, circumvent, or interfere with the Services or their security, licensing, or access controls (including anti-tamper, integrity, or authentication mechanisms)
- Use the Services to compete with ProjectMods or for unauthorised commercial enterprise
- Collect usernames or email addresses to send unsolicited communications
Violation may result in suspension, termination, removal of content, and/or legal action.
7. Reviews & Community Guidelines (If Enabled)
If the Services allow reviews or ratings, you agree that reviews:
- Reflect genuine firsthand experience
- Are not abusive, hateful, discriminatory, or unlawful
- Do not contain false or misleading statements
- Do not organise coordinated campaigns to manipulate reviews
ProjectMods may accept, reject, or remove reviews at our discretion. Reviews are not endorsed by ProjectMods.
8. Social Media & Third-Party Accounts (If Enabled)
If you link your account to third-party services:
- You are responsible for complying with third-party terms
- ProjectMods is not responsible for third-party content, availability, or policies
- We may access and store content as permitted to enable the integration
- You can disconnect third-party accounts where supported
If you link Discord and optionally provide your birth month and day (see Section 10.5), we may assign a temporary birthday role and post a public birthday shout-out that mentions your Discord account in our community server on that calendar day each year.
9. Third-Party Websites & Content
The Services may include links to third-party websites or content. ProjectMods does not control, monitor, or endorse third-party websites or content and is not responsible for them.
Any interactions, purchases, or use of third-party content are at your own risk and governed by those third parties' terms.
10. Virtual Items, Memberships & Payments
10.1 Virtual Items
ProjectMods may offer virtual currencies, points, rewards, or similar items ("Virtual Items").
Virtual Items:
- Have no real-world monetary value
- Are not redeemable for cash unless required by law
- Are licensed, not owned
- Are non-transferable unless expressly stated
- May be modified, suspended, or removed at any time
10.2 Memberships, Subscriptions & Refunds
Payments are processed by our payment provider, Stripe. We store limited billing information (such as your Stripe customer and subscription IDs) and never store your full card details.
If paid memberships or subscriptions are offered:
- Subscriptions auto-renew at the end of each billing period (monthly or yearly, as selected at purchase) unless you cancel before the renewal date
- You may cancel a subscription at any time through your account settings or the Stripe customer billing portal linked from your account
- If you request manual cancellation by email (for example to [email protected]), you must give us at least 48 hours' notice before your next scheduled renewal. If we charge you because you did not provide enough notice, that renewal charge is not eligible for a refund
- Purchases and subscription fees are final and non-refundable, except where required by law or where we are legally obliged to provide a remedy
- Australian consumers: Nothing in these Terms excludes, restricts, or modifies rights you have under the Australian Consumer Law (including consumer guarantees) that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law
- Premium membership includes a higher daily limit for mod suggestions, but does not prioritise or guarantee implementation of any suggestion
- Failure to implement a suggestion does not entitle you to a refund
10.3 Mods & Premium Content Availability
Mods, premium features, virtual items, and related content may be added, changed, limited, or removed at any time, with or without notice. We do not guarantee that any mod or feature will remain available. No refunds are provided solely because a mod or feature was removed, changed, or discontinued, except where required by law.
10.4 Cancellation (If Applicable)
To avoid automatic renewal, you must cancel via the designated account cancellation feature or billing portal prior to the renewal date. Other cancellation methods may not be accepted unless we confirm them in writing.
10.5 Birthday Rewards Program (Optional)
You may optionally provide your birth month and birth day in account settings to participate in our birthday rewards program. We do not collect your birth year.
If you opt in:
- On your birth month and day each calendar year (UTC), we may credit Cyber Credits (Virtual Items) to your account, typically once per year per account
- If you have linked Discord, we may grant a temporary Discord role and post a public birthday shout-out that mentions your linked Discord account
- Gift amounts, role names, shout-out format, and eligibility rules may change or end at any time
You agree that:
- Providing birthday information is voluntary and must reflect a genuine month and day you are comfortable sharing
- You will not provide false or misleading dates to obtain rewards, roles, or shout-outs
- Birthday rewards are promotional Virtual Items with no cash value, subject to the Virtual Items rules in Section 10.1
- Removing your birthday or unlinking Discord stops future birthday rewards and related Discord features until you opt in again
ProjectMods may suspend or revoke birthday rewards if we reasonably suspect abuse, fraud, or policy violations.
11. Game Modifications & Third-Party Games
11.1 Mod Compatibility & Risk
You acknowledge that:
- Mods may affect game performance, stability, files, save data, or gameplay
- Mods may break due to updates or conflicts
- You are responsible for backing up game files before installing mods
ProjectMods is not responsible for damage to game files, save data, or hardware resulting from mod use.
11.2 Third-Party Games, Online Play & Publisher Policies
ProjectMods is not affiliated with game developers or publishers unless explicitly stated.
Use of mods may violate third-party terms of service or policies. You are responsible for checking and complying with those terms.
Online play, anti-cheat, and leaderboards: Mods may affect online multiplayer, anti-cheat systems, in-game leaderboards, achievements, or account standing. You use mods at your own risk. We recommend offline or single-player use where publisher policies restrict modifications. ProjectMods is not responsible for bans, suspensions, loss of progress, or enforcement actions taken by game publishers, platform holders, or anti-cheat providers.
12. Modifications, Interruptions & Corrections
We may change, modify, remove, correct, or update content on the Services at any time.
We do not guarantee that the Services will always be available and may experience interruptions, delays, errors, or maintenance.
ProjectMods is not liable for loss, damage, or inconvenience caused by your inability to access or use the Services.
13. Disclaimers & Limitation of Liability
13.1 Disclaimer of Warranties
The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
13.2 Limitation of Liability
To the maximum extent permitted by law, ProjectMods and its officers, employees, agents, and affiliates are not liable for any direct, indirect, incidental, consequential, exemplary, special, or punitive damages, including loss of profits, revenue, data, game progress, or goodwill.
ProjectMods' total liability will not exceed the amount you paid to ProjectMods, if any, in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless ProjectMods, including its affiliates, and their respective officers, agents, partners, and employees, from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from:
- Your User Content
- Your use of the Services
- Your breach of these Terms
- Your violation of laws or third-party rights
- Any harmful act toward another user
ProjectMods reserves the right to assume exclusive defence and control of any matter subject to indemnification, at your expense, and you agree to cooperate.
15. Privacy Policy
Your use of the Services is subject to our Privacy Policy, which is incorporated by reference.
Your information may be stored and processed in Australia, the United States, and other countries where our service providers operate (see our Privacy Policy for details). By using the Services, you acknowledge your data may be transferred to and processed outside your country.
You may submit a request to access or delete your personal information using the "Request my data" tool in your account settings. We verify your identity and handle requests manually within the timeframes described in our Privacy Policy (including within 30 days for Australian requests where applicable). This is not an instant automated download or deletion.
16. Copyright Infringement & Takedown Requests
If you believe content on the Services infringes your copyright, please send a notice to [email protected] (subject line: "Copyright Notice") or [email protected] with:
- Identification of the copyrighted work you claim has been infringed
- Identification of the material on the Services that you claim is infringing, including the URL or sufficient detail for us to locate it
- Your contact information (name, address, telephone, and email)
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law
- A statement, under penalty of perjury where applicable, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf
- Your physical or electronic signature
We may remove or disable access to material that we believe infringes copyright. If you believe material was removed in error, you may submit a counter-notice to the same contact addresses including:
- Identification of the material that was removed and where it appeared
- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification
- Your name, address, phone number, and consent to the jurisdiction of the courts in Victoria, Australia (or your jurisdiction if required by applicable law)
- Your physical or electronic signature
We may restore removed material in accordance with applicable law. Misrepresentations in a takedown or counter-notice may result in liability under applicable law.
17. Term & Termination
These Terms remain in effect while you use the Services.
ProjectMods may, in our sole discretion and without notice where permitted by law:
- Suspend or terminate your account
- Deny access to the Services (including IP blocking)
- Remove content or information you posted
If your account is terminated, you may be prohibited from creating a new account.
You may terminate your account at any time by contacting support or using available account tools.
18. Electronic Communications, Transactions & Signatures
By using the Services and communicating with us electronically, you consent to receive communications electronically and agree that electronic agreements and signatures satisfy legal requirements.
19. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Victoria, Australia, and the Commonwealth laws applicable there.
You and ProjectMods submit to the non-exclusive jurisdiction of the courts of Victoria. Nothing in this clause limits any protection you have under the mandatory consumer laws of your country of residence.
20. Miscellaneous
- These Terms and any posted policies constitute the entire agreement between you and ProjectMods
- Our failure to enforce any right is not a waiver
- We may assign our rights and obligations
- If any provision is unlawful or unenforceable, the remainder remains in force
- No joint venture, partnership, employment, or agency relationship is created
